Prison, Restitution Ordered for Utica, NY Man for Auto Insurance Fraud

John Biagini, Sr., 50, of Utica NY was sentenced to serve 37 months in federal prison and to pay $80,900 in restitution to several insurance companies after pleading guilty to filing numerous fraudulent auto repair claims.

According to a report from the New York State Insurance Department,”Biagini, Sr. admitted that, between 1995 and 1999, he routinely caused the submission of false and fraudulent claims to various automobile insurers for repairs purportedly performed by Johnnies Automotive, 1203 Catherine Street, Utica, New York. In some cases, all of the damage to an automobile was intentionally inflicted by Biagini or his employees by staging an accident or vandalism in order to generate a fraudulent claim for the repair of the damage created.”

“The damage to an automobile was often intentionally enhanced by Biagini or his employees, acting at his behest, in order to inflate the amount of the claim for repairs. In many cases, Biagini falsely claimed that Johnnies Automotive performed repairs that were not, in fact, done or supplied new parts that were not, in fact used in making repairs,” the bulletin continued.

It noted that Biagini, Sr.’s arrest was a result of a joint investigation carried out by the NYSID’s Frauds Bureau, the New York State Organized Crime Task Force, the New York State Police Special Investigations Unit, the Oneida County Sheriff’s Department, and the Federal Bureau of Investigation.
